Terms of Service
These are the rules for using this website and anything we publish. Like our privacy policy, we have kept them short. Where something is genuinely in our favour we have said so rather than burying it.
Who you are agreeing with
MB Ombelia, a Mažoji bendrija registered in Lithuania under registration code 000000000, at Street name 00-00, LT-00000 Vilnius, Lithuania. In these terms that is "we" and "us". "You" is whoever is reading this.
What these terms cover
This website, and any application we publish. If an application ever comes with its own terms, those win for that application and these continue to cover everything else.
Using this website
You may read it, link to it, and write to us through it. Please do not try to break it, overload it, scrape it at a volume that costs us money, or use it to do something illegal. If you send us a message, send us something you are willing to have on record.
Our applications
We have not published any applications yet. When we do, they will be distributed through Apple's App Store and will also be subject to Apple's Licensed Application End User License Agreement. Where Apple's terms and ours disagree about the licence itself, Apple's win. Purchases, refunds and subscriptions will be handled by Apple, not by us — so a refund request goes to Apple, though we would rather you told us what went wrong.
When an application exists, we will grant you a personal, non-transferable licence to use it on devices you own or control. You will not be able to resell it, or reverse-engineer it beyond what the law expressly permits.
Who owns what
We own our software, its design, its name and the contents of this site. You own whatever you create using our software. We do not claim a licence over your content, and we do not want one.
Availability
We will try to keep things running, but we do not promise uninterrupted service. We may change, pause or discontinue a product or a feature. If you are paying for something when that happens, we will give reasonable notice.
Warranties and liability
Our software is provided as-is, to the extent the law allows. Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — and if you are a consumer in the EU, your statutory rights are untouched by this document.
Subject to that, our total liability arising from your use of a product is limited to what you paid us for it in the twelve months before the claim. If you paid us nothing, that is the limit, and we would rather be upfront about it than hide it in a longer sentence.
Ending this
You can stop using our software whenever you like. We may withdraw access if someone is using it to break the law or to damage our systems, and we will tell you why unless we are legally prevented from doing so.
Changes
If these terms change we will update the date at the top. Material changes will be stated plainly rather than slipped into a paragraph.
Governing law
The law of Lithuania governs these terms, and its courts have jurisdiction — except where consumer protection law lets you bring proceedings in your own country, which it usually does.
